Can my daughter get in trouble for Sending this pic?

Okay so my 20 year old daughter sent a picture several months ago before turning 20. The picture was of her butt in underwear. The person she sent it to claimed to be older but it turns out he wasn't. His mom found out about this picture as soon as it happened, but is just now deciding to take it to court. Some kids his age came over and were telling me that they supposedly went to court with them that day and said that the States Attorney would have a warrant out for my daughter's arrest Friday! Can she wait that long before turning in the cell phone? Could somebody of had to question my daughters side of the story before arresting her? And one other thing my daughter has a 9 month old baby, my grandson, she does not have a job and I am the prime caregiver of the child, I buy his food, diapers, clothes, everything. Will they take my grandson if she gets arrested? Or do I keep him due to the facts that I am his Prime Caregiver!
